Angels On Assignment Nursing Care

(“the Business”, “we”, “our”, or “us”)

 

These Terms and Conditions govern the provision and use of caregiving, child care, housekeeping, nursing, companion care, and all other support services (“the Services”) offered by Angels On Assignment Nursing Care. By engaging our services, the Client (“you”, “your”) acknowledges that you have read, understood, and agreed to the following terms, policies, responsibilities, and limitations.

1. GENERAL PROVISIONS

 

1.1 Nature of the Business

Angels On Assignment Nursing Care is a registered and legally operating care service business offering professional support staff including caregivers, nurses, nannies, child care specialists, and housekeepers. We are not a freelance matching platform; we provide structured, monitored, and regulated services governed by established policies.

 

1.2 Acceptance of Terms

These Terms and Conditions form a binding agreement between the Client and the Business. All clients must review these terms before receiving services.

 

1.3 Right to Amend

The Business reserves the right to revise these Terms and Conditions at any time. Updated versions will be communicated via email or official correspondence.

2. SERVICE DELIVERY

 

2.1 Scope of Services

Services may include but are not limited to:

 

Elderly care

 

Child care and live-in nanny services

 

Housekeeping and home management

 

Companionship

 

Post-hospitalization support

 

Specialized care depending on Client needs

 

 

2.2 Assignment of Caregivers

Caregivers are assigned based on availability, experience level, and suitability for the Client’s needs. While we consider Client preferences, we cannot guarantee a specific personality type or match.

 

2.3 Live-In Services

For live-in placements, the Client must provide:

 

A safe and private sleep space

 

Access to bathroom facilities

 

Reasonable meals or meal accommodation

 

A respectful, safe, and non-hostile living environment

 

 

2.4 Work Schedule

Caregivers will operate based on the agreed schedule documented in the proposal or service agreement. Clients must respect the caregiver’s off days and rest periods.

 

2.5 Duties and Responsibilities

A detailed job description will be provided based on the Client’s requested service package. Duties outside of this agreed scope must be negotiated with the Business, not with the caregiver directly.

3. PAYMENT TERMS

 

3.1 Service Fees

Pricing for services is communicated in writing and may vary based on service type, duration, complexity, and location.

 

3.2 Payment Method

Payments must be made directly to the Business’s official bank account:

3.3 Advance Payment

All services require payment before placement of the caregiver unless the Client has been approved for a specific payment arrangement.

 

3.4 Late Payments

Late payments may result in service suspension, removal of staff from location, or additional fees.

4. REFUND POLICY

 

4.1 Refund for Prepaid Services

If a Client prepays for a service and wishes to cancel, they may receive a full refund only if cancellation is made before 00:00 (midnight) of the day following the payment/service confirmation date.

 

4.2 Non-Refundable After Midnight

If cancellation occurs after 00:00, the service becomes non-cancelable and non-refundable.

 

4.3 No Refund Once Caregiver Arrives

Once a caregiver has arrived on location, the Client is not eligible for any refund, regardless of whether the Client chooses to discontinue the service.

 

4.4 Refund for Service Non-Delivery

If the Business is unable to supply a caregiver and the Client does not wish to wait for a replacement, a full refund will be granted.

5. CLIENT RESPONSIBILITIES

 

5.1 Safe Working Environment

Clients must ensure that the caregiver’s environment is safe, respectful, and free from abuse, harassment, threats, or unsafe conditions.

 

5.2 Compliance with Labour Regulations

Clients must respect working hours, rest breaks, and off days specified in the service agreement.

 

5.3 No Direct Hiring

Clients are strictly prohibited from directly hiring or attempting to hire a caregiver assigned by the Business without written approval. Breach of this term attracts a penalty fee equal to six (6) months of service fees.

 

5.4 Honesty in Reporting

Clients must provide accurate medical, behavioral, and environmental information relating to the care recipient.

6. BUSINESS RESPONSIBILITIES

 

6.1 Professional Staffing

We provide trained, vetted, and background-checked caregivers.

 

6.2 Monitoring & Support

We conduct periodic check-ins with both clients and staff to ensure service quality.

 

6.3 Replacement of Staff

If a caregiver becomes unavailable due to illness, emergency, or resignation, the Business will provide a replacement as soon as possible.

7. LIMITATION OF LIABILITY

 

7.1

The Business will not be held liable for:

 

Acts of negligence or misconduct by the client

 

Inaccurate information provided by the Client

 

Unsafe home conditions

 

Issues arising from Clients changing job duties without authorization

 

Losses caused by natural disasters, emergencies, or unforeseen circumstances

 

 

7.2

The Business is not responsible for personal items lost or damaged unless proven to be caused by intentional wrongdoing by the caregiver.

8. TERMINATION OF SERVICE

 

8.1 By the Client

Clients may terminate service by providing written notice as outlined in their service agreement.

 

8.2 By the Business

The Business may terminate services immediately if:

 

The caregiver is being mistreated

 

The client displays aggression, harassment, or abuse

 

The environment is deemed unsafe

 

Payments are consistently late

 

There is a breach of contract

9. CONFIDENTIALITY

 

All personal information and private details of clients are held in strict confidence. The Business prohibits caregivers from sharing photos, videos, or private matters of the household.

10. GOVERNING LAW

 

These Terms and Conditions are governed by the laws of Jamaica. Any disputes shall be resolved through arbitration or the appropriate legal framework.

11. ACKNOWLEDGMENT

 

By paying for and receiving services, the Client acknowledges that:

 

They have read and accepted all terms

 

They agree to comply fully

 

They understand the refund policy, payment terms, and expectations
